Welcome to Urbane Tek Insurance! The document is an electronic record in terms of Information Technology Act, 2000 and published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries guidelines) Rules, 2011.

UrbaneTek Advisors Pvt Ltd a company incorporated under the Companies Act, 2013 (“Us”, “We”, “Our” or “UrbaneTek”) is the owner of  https://urbanetek.com as well as the software and applications provided by UrbaneTek i.e. UrbaneTek Insurance. The website  https://urbanetek.com and the application UrbaneTek Insurance are collectively referred to as the “Sites”.

These terms of use apply to all user(s) accessing or using Our Sites, or otherwise engaging with Us through e-mail or other means (hereinafter referred to as “You” or “Your” or “User”). These terms of use along with the privacy policy ("terms") including the applicable policies which are incorporated herein by way of reference, govern the conditions of Your access and use of the Sites, transaction through the Sites and use of Services (as defined herein below) hosted or managed remotely through the Sites. These Terms of Use constitutes a legal and binding contract between You and UrbaneTek.

By signing up to use and accessing the Sites, downloading, or installing and using Our application, you at will confirm and agree to be bound by these terms. If You do not agree to be bound by these terms, you are not entitled to download, access, or use Our Sites and are required to delete any versions of the mobile application and any data downloaded by You while using the Sites.

  1. GENERAL TERMS
  1. The Sites are a platform that facilitates insurance services being offered by various third-party insurance companies and Third-Party Administrators (“Insurance Companies”).
  2. Any insurance policies solicited by us are issued by the Insurer. We do not underwrite the risk or act as an Insurance Companies at any time. The risk is underwritten by the Insurance Companies only.
  3. You may purchase insurance policies at your sole discretion and purely on a voluntary basis.
  4. The contract of insurance will be between the Insurance Companies and you, to the exclusion of us. Accordingly, we are not responsible or liable for performance or enforcement of any of your benefits or rights under the contract of insurance with the Insurer. Any disputes arising in relation to the contract of insurance are between you and the Insurance Companies. For more details on risk factors, product details, terms and conditions and exclusions please read the relevant product brochure carefully before conclusion of sale.
  5. We reserve the right to change or modify these Terms of Use or any policy or guideline of the Sites including the Privacy Policy, at any time and in Our sole discretion. Any changes or modifications will be effective immediately upon posting the revisions on the Sites. Your continued use of the Sites will confirm Your acceptance of such changes or modifications; therefore, You should frequently review these Terms of Use and applicable policies to understand the terms and conditions that apply to Your use of the Sites and Services.
  6. By visiting the Sites or accepting these Terms of Use, You represent and warrant to Us that You are competent to contract and that You have the right, authority and capacity to use the Sites and agree to and abide by these terms.
  7. You acknowledge and understand that UrbaneTek provides no warranty or representation with respect to the authenticity of the information provided on the Sites and You must do Your own check. Our Content is the property of UrbaneTek and is protected under copyright, trademark and other applicable law(s).
  8. Compliance with these terms would entitle You to a personal, non-exclusive, non-transferable, limited privilege to access and transact on the Sites.
  1. USER ACCESS
  1. For the purposes of availing the Services and/or transacting with the Insurance Companies through the Sites, You are required to obtain registration, in accordance with the procedure established by Us in this regard. As part of the registration process, We may collect the following Information from You including without limitation Your name, User ID, email address, address, gender, age, contact number, health, medical history and data, insurance data, personnel details, password chosen by the User, financial account information and other details as You may provide.
  2. We, at Our sole discretion, with or without any reason, reserve the right to permanently or temporarily suspend Users, to bar their use and access of the Sites, at any time while We investigate complaints or alleged violations of these terms or any Services, or for any other reason.
  1. TERMS OF USE
  1. In consideration of your access to and/or use of the Sites, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of India or other applicable jurisdiction and will only use the Sites to make legitimate purchases for you or for another person for whom you are legally authorized to act (and will inform such other persons about these Terms, and our Privacy Policy) that apply to the purchase you have made on their behalf (including all rules and restrictions applicable thereto).
  2. You also agree to provide true, accurate, current and complete information about yourself as prompted by the Site.
  3. In case you provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate or refuse any and all current or future access to and/or use of the Sites (or any part thereof), or take any other action as we deem fit.
  4. You are responsible for maintaining the confidentiality of your account and password, and for restricting access to your computer/ devices.
  5. You agree to accept responsibility for all activities that occur under your account or password.
  6. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We retain the right at our sole discretion to deny access to anyone to the Sites and/or the Services we offer, at any time and for any reason, including, but not limited to, for violation of the Terms, and/or Privacy Policy
  7. You agree to abide by the terms and conditions of purchase imposed by the Insurance Companies, including, but not limited to, compliance with the Insurance Companies rules and restrictions regarding use of products, and/or Services. You agree that any violation of the Insurance Companies rules and restrictions may result in cancellation of your purchase(s), you being denied access to the applicable Services or any other restriction that the Insurer may impose.
  1. DISCLAIMER OF WARRANTY AND LIABILITY
  1. The information provided on the Sites for information and solicitation only. Information in relation to the services are solely based on the information received from the Insurance Companies. We do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to the information and description of the content, products, and Services offered on the Sites. We expressly reserve the right to correct any pricing errors on the Sites and/or on pending reservations made under an incorrect price or differential price.
  2. All information, content, materials, and services included on or otherwise made available to you are provided by us on an "as is" and "as available" basis, unless otherwise specified in writing. We disclaim all representations or warranties, express or implied, with respect to the operation of Sites, including without limitation, any express or implied representation or warranty of merchantability or fitness for a particular purpose.
  3. If applicable law does not allow limitations on implied warranties or the exclusion or limitation of certain damages, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have additional rights.
  4. In no event will we or our directors, officers, employees, agents or other representatives be liable for any indirect, special, incidental, consequential, or punitive damages, or any other damages of any kind, arising out of or related to the Services.
  1. USER PREMIUM PAYMENT

Please note that we are only collecting or assisting in collecting the premium amount on behalf of the Insurance Companies. The acceptance of the amount as premium and final issuance of the policy is subject to the underwriting norms and discretion of the Insurance Companies, on which we have no control.

  1. USER KYC REQUIREMENTS

If any KYC process documents are mandated by the Insurance Companies and is required under the applicable laws, you will be required to comply with such KYC requirements and you agree to provide the relevant documents and or information to us and/or Insurance Companies, as required. We and/or Insurance Companies may also request you for any other/ additional information/ documents to establish your identity or for any other purpose as we may deem fit.

  1. MODIFICATION OF THE SITES

UrbaneTek reserves the right to modify or discontinue, temporarily or permanently, the Sites or any features or portions thereof without prior notice. UrbaneTek and/or Entities will not be liable for any modification, suspension or discontinuance of the Sites or any other part thereof.

  1. INTELLECTUAL PROPERTY RIGHTS

All the intellectual property used on the Sites except those which have been identified as the intellectual properties of the Other Parties shall remain the exclusive property of UrbaneTek. You agree not to circumvent, disable or otherwise interfere with security related features of the Sites or features that prevent or restrict use or copying of any materials or enforce limitations on use of the Sites or the materials therein. The materials on the Sites or otherwise may not be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted or transmitted in any form or by any means, including but not limited to, electronic, mechanical, photocopying, recording or other means.

  1. FORCE MAJEURE

For the purpose of this clause, “Force Majeure” means and includes any Vis Major (act of God) and also any circumstance beyond the reasonable control of the Parties hereto, including without limitation, the following: any act of nature or the public enemy, accident, explosion, fire, storm, earthquake, flood, drought, perils of the sea, casualty, pandemic, strikes, lock-outs, labor troubles, riots, sabotage, embargo, war (whether or not declared), governmental laws, regulations, orders, or decrees, unavailability of raw material or seizure. You agree and acknowledge that UrbaneTek shall not be liable for any loss or damage caused to You as a result of a Force Majeure event. In the event of Force Majeure, UrbaneTek, depending upon impact, shall give notice to You of the facts which constitute the Force Majeure event.

  1. TERMINATION

You agree that UrbaneTek, with or without any reason, may immediately terminate your access to the Sites, without prior notice. Without limiting the foregoing, UrbaneTek may terminate or temporarily suspend the User access to the Sites for any reason, including without limitation a) breach or violation of any of the contractual obligations, including these terms b) there is a request by law enforcement or other government agencies, or c) in case of unexpected technical issues or problems. You agree that all terminations of access to the Sites shall be made at the sole discretion of UrbaneTek and that UrbaneTek shall not be liable to You in any manner whatsoever for any termination of access to the Sites.

  1. SEVERABILITY

In the event that any provision of these terms is held unenforceable, the validity or enforceability of the remaining provisions will not be affected, and the unenforceable provision will be replaced with an enforceable provision that comes close to the intention underlying the unenforceable provision.

  1. GOVERNING LAW AND DISPUTE RESOLUTION

These terms are governed by the laws of India without giving effect to any principles of conflict of laws. Any legal action or proceeding related to User access to, or use of, the Sites and/or Services or these Terms of Use shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra, India.
